We have extensive experience in all types of collective actions (by means of a representative ad litem, among others) and claims for collective redress (or “class actions”) in which we act for on behalf of claimants or Belgian and foreign defendants or their liability insurers.
We represent clients in all Belgian courts, coordinate class actions for other European judicial bodies, and act as an expert on Belgian law aspects in matters brought before foreign courts (e.g., in common law courts, etc.)
Most class actions or proceedings involving multiple parties relate to issues of consumer rights or investment in financial products (such as financial products or investment insurances).
Some examples of our recent or ongoing matters in this domain include:
- assisting and defending the Belgian consumer organisation Test Aankoop in the class action against the Volkswagen group subsequent to the emissions scandal;
- assisting in the Belgian class action against Facebook subsequent to the way in which Facebook deals with privacy and personal data of its users;
- defending banks in class actions (avant la lettre) pertaining to the sale of financial products and to the alleged sale of investment products through their network of independent bank agents.
