We assist our clients in prosecutions for all types of market abuse (market manipulation, abuse of insider information, ...). We do this in administrative proceedings brought before the FSMA (Financial Services and Markets Authority) as well as in criminal proceedings.
Regulators have many ways to detect and charge various forms of market abuse. Given the market-disruptive nature of these crimes, they are ranked high on the priority list for prosecution.
We have assisted many clients in criminal proceedings and administrative proceedings before the Sanctions Committee of the FSMA. If appropriate, we try to avoid actual prosecution by seeking a fair arrangement with the competent authorities.
Some examples of our work in market-abuse matters include:
- assisting the CFO of a public-listed company in an investigation conducted by the FSMA into market manipulation;
- assisting a public-listed company and some of its directors and CEO in an investigation conducted by the FSMA into facts concerning market manipulation.
