We assist clients in all types of product liability cases in the broad sense, i.e., all types of cases in which damage can be caused by a defect in a product. We assist them both in civil and criminal matters.
Most of these cases concern a wide range of products: animal food, beverages, cars and car parts, food, machines, medicines, medical devices (e.g., artificial hips, prosthetic devices, operation equipment), steel products, etc. Many of these cases have an international element because the products are sold in different countries. We represent manufacturers, importers, and suppliers, and, in certain cases, we also represent the aggrieved parties.
Some examples of our work in product liability include:
- defending a global materials technology and recycling group and its insurer in a product liability matter relating to steel properties after galvanizing, and coordinating proceedings in Belgium, the US, France and Germany;
- assisting a US commercial property casualty insurer in relation to an industrial fire allegedly caused by a component of a refrigeration unit of a truck;
- assisting a global diversified technology and multi-industrial leader with its defence against an indemnification claim brought by a customer on grounds of alleged defects in a refrigeration unit that broke down and necessitated the shutting down of a part of a chemical plant;
- assisting a leading car manufacturer in all its product liability matters;
- assisting a leading manufacturer of hip-replacement products against various consumer claims, and coordinating its defence in other countries.
